The EU introduced a new Directive, DAC6, which came into force on 25 June 2018 and requires Member States to automatically exchange information on cross-border arrangements. The rules specifically require intermediaries and in some cases taxpayers to report cross-border arrangements that fall within specific Hallmarks.
The rules require a retrospective exercise from 25 June 2018 to identify any reportable arrangements and report them by 31 August 2020. A 30-day reporting requirement comes into force on 1 July 2020. The reporting deadlines are fast approaching and therefore we recommend businesses act now to ensure they are compliant and mitigate any potential penalties for non-compliance.
